Halle Berry wants former custody agreement back in latest row with ex

Halle Berry wants her former custody agreement for her 12-year-old son to be reinstated.

The 60-year-old Hollywood star, who has son Maceo with ex Olivier Martinez, also 60, has asked a court to restore her 50/50 custody agreement from August 2023 and claimed their boy leaves his dad’s house “angry” at his mother.

As reported by PEOPLE magazine, court documents reveal Berry is asking for the 50/50 agreement to be reinstated, as well as her position as the tie-breaking authority.

She also wants Martinez to be forced to attend their court-ordered therapy sessions.

The Gothika actress didn’t directly acknowledge her ex’s recent allegations she abused their son in the filing.

However, she wrote: “The fourth concern is Olivier’s continued attempts to align Maceo with him and against me in many areas of our child’s life and activities which causes Maceo to be angry with me about private issues relating to Maceo which Olivier and I were discussing at the time.”

Elsewhere, she claimed that after spending time with his father, their son can be “angry and combative” towards his mother.

Berry alleged: “When Maceo would come home from his custodial time with Olivier, he would be angry and combative.

“It took Maceo 2-3 days to acclimate to being at home and when he would go back to Olivier, the cycle would start all over again.

“I also perceived Maceo to repeat disputes that Olivier and I discuss in private and take Olivier’s side/position in that dispute.”

She noted that there have been disputes “related to a decision regarding Maceo” – citing possible issues as “soccer, school, or therapy” – and her son “knew about it” before his parents had “reached a decision”.

Berry has claimed her son would tell her what he and her ex had decided to do “without my input”.

The star also alleged that her ex’s actions and lack of cooperation with Maceo’s educational and psychological needs have had an impact on his welfare.

She argued: “[Martinez’s] refusal to allow early interventions have caused Maceo to fall further behind in school, caused Maceo’s acting out behaviors to worsen, and caused further damage to Maceo’s and [Berry’s] relationship.”

Berry claimed Martinez has said Maceo is “old enough” to make his own choices, but she has disagreed.

She said: “While I am attuned to Maceo’s thoughts and feelings and encourage an open dialogue, I do not agree that a ten-year-old should be permitted to make decisions regarding his education, health, extracurricular activities, and general welfare.”

Elsewhere, she claimed that Martinez hasn’t accepted her fiancé Van Hunt as her partner, and that he has made “active attempts to influence Maceo’s teachers and therapist to view me as a risk to our child by communicating false stories”.

Martinez has filed a response in which he has asked the court to deny the request in its entirety.

He cited his temporary restraining order against Berry, and alleged there is a risk of “immediate danger” to their son.

In his October 1 petition Martinez alleged that Berry caused him “emotional and mental distress due to physical abuse of our minor child, Maceo”.

He claimed she “grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?'”

In a statement to Entertainment Weekly, Berry’s attorney Marina Beck has described Martinez’s decision to file the lawsuit as “outrageous conduct”.

She said: “To say this filing is entirely meritless and deliberately misleading would be an understatement.”

She has also accused Martinez of being “erratic” and possessive”, as well as having “violated court orders and interfered with therapeutic and educational interventions” involving Maceo.

The lawyer added: “Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”
