Kyle Sandilands has been handed a subpoena live on air on Wednesday morning in an extraordinary blow to the radio star as his former co-host Jackie ‘O’ Henderson continues her legal battle with ARN.
The 55-year-old was broadcasting his new subscriber-only show, Kyle Sandilands Live, when his manager and producer, Bruno Bouchet, presented him with legal papers during the program.
“They were trying to get to you last night, but they could only get on to me, so they asked me to pass it on to you,” Bouchet said to Sandilands after he handed him the papers in the studio.
“It’s a subpoena for the trial.”
Sandilands appeared caught off guard by the development, with the moment unfolding live in front of his show’s live audience.
“Against Jackie?” Sandilands asked, to which Bouchet confirmed, “Yes”, before adding, “It is also a notice to produce documents.”
“I’m very uncomfortable about that,” Sandilands said, before throwing the notice papers into a bin.
“Just tell them I’m overseas or something. Is that what happens? How do you get out of this?”
Newseader Brooklyn Ross asked his boss for clarification: “Does ARN want you to be on their side against Jackie?”
“Well that makes me feel very uncomfortable,” said Sandilands.
“I came in feeling great. I was a bit embarrassed about feeling sad last week, and now you dump this s..t on me.”
The latest development marks another chapter in the bitter legal dispute that continues to unfold following the collapse of Sandilands and former KIIS co-host Henderson’s long-running radio partnership.
Kyle Sandilands Live was established after the shock jock reached a multi-million-dollar settlement with ARN following his departure from the network.
Despite the settlement between Sandilands and ARN, Henderson’s separate legal action against the broadcaster is continuing and is expected to proceed to trial later this year.
Henderson has filed a lawsuit against parent network ARN over alleged matters relating to her employment and treatment at the network.
She is seeking at least $82.5 million and has alleged that aspects of her experience at the network caused significant psychological distress that developed into post-traumatic stress disorder.
These allegations have not yet been determined by a court.
The pair spent more than two decades working together and became one of Australia’s most recognisable radio partnerships.
Their professional relationship ultimately came to an end during an explosive on-air feud in February when Sandilands said Henderson’s fixation on horoscopes made her “almost unworkable”, claiming she was “off with the fairies” and neglecting other parts of her job.
