Yung Filly to be re-tried on three rape charges less than month after found not guilty of raping Perth woman

British rapper Yung Filly will be re-tried on three rape charges less than a month after he was found not guilty of raping a young fan in Perth.

A WA District Court jury last month found Andreas Felipe Valencia Barrientos not guilty of three counts of sexual penetration without consent, one count of assault and one count of impeding another person’s normal breathing or blood circulation by applying pressure to neck.

The 30-year-old was found guilty of two assault charges which included biting the woman on her neck and breast.

The jury was unable to reach a verdict on three charges of sexual penetration without consent.

State prosecutor Danielle Clarke on Friday confirmed the State was seeking a re-trial on the three hung counts.

She said the complainant was willing to give evidence again.

Ms Clarke also said she wanted Mr Barrientos to be sentenced for his two assault charges after his re-trial.

The matter will return to court on August 27 where his defence counsel will apply for a variation to his bail conditions.

Bail was extended.

The court previously heard that Barrientos approached the complainant in the nightclub’s VIP area, telling her, “You’re coming home with me tonight” and allegedly putting his hand down the back of her pants.

Afterwards, the pair went to the InterContinental Hotel where they engaged in consensual sex.

But the sex allegedly turned non-consensual when Barrientos allegedly bit her neck, cheek and breast, causing bruising and swelling.

He allegedly strangled the complainant, slapped her face four times and ordered her to say derogatory phrases like, “I’m Filly’s dirty whore” and call herself a “fat pig”.

The rapper allegedly continued assaulting the complainant before violently raping her and forcing her to perform fellatio.

Barrientos said he recalled putting his hand around the complainant’s waist at the nightclub, but denied putting his hand down her pants and touching her breast.

He said the complainant was “grunting and moaning in a good way”, and showed no indication of pain or discomfort.

Barrientos denied strangling, slapping and recording the complainant during sex, and maintained the bruises were caused by “love bites”.
